You bought legal expenses insurance, but the provider refuses your case, makes little progress or will not fund your chosen lawyer. Alternatively, your home or motor insurer rejects a claim. Arslan Advocaten helps you identify the actual dispute and an appropriate response from our Tilburg office.
A disagreement about cover, the prospects of success and the quality of legal assistance are different issues. Send the decision, applicable policy and key dates. Tell us immediately if the underlying dispute has its own deadline; a complaint about your insurer does not automatically suspend it.

Tell us immediately about any complaint, response or court deadline. An enquiry does not itself create an engagement or extend a deadline.
Start with the precise reason for refusal
Ask whether the insurer disputes cover or believes that pursuing the underlying case has insufficient prospects. Cover may depend on the insured module, the start date or when the conflict arose. A disagreement about legal strategy can involve different policy provisions from a disagreement about whether the matter is insured at all.
Place the policy schedule, relevant conditions and refusal side by side. A purchase date, the first complaint and a later refusal by the seller may be different dates. Record each rather than assuming the insurer’s decision date determines cover. Include the versions of the conditions applicable at the relevant time.
Also identify outstanding information requests. A request for a contract or invoice is not necessarily a final refusal. Supply relevant documents and keep proof of sending. If the same documents are requested repeatedly, prepare a list showing what has already been provided and when.
The policy’s dispute-resolution procedure
Many legal expenses policies provide a procedure for disagreement about the approach or prospects of success. Check its scope, how the reviewer is selected and which documents must be submitted. A cover dispute does not automatically qualify for the same procedure.
Explain the disputed assessment precisely. Does the handler overlook a witness, interpret a contract incorrectly or omit a relevant document? Show where the evidence supports your position. A general statement that you disagree provides less guidance than specific objections.
Clarify the cost and effect of the second opinion before commissioning it. Can the original handler continue, is a transfer possible, and what happens if the reviewer agrees with the insurer? The answer depends on the policy. Our guide to a refused dispute-resolution procedure explains the preparation.
Changing the handler and choosing your own lawyer
Poor communication does not automatically entitle you to an outside lawyer at the insurer’s expense. First identify what needs to improve: responsiveness, planning, substantive advice or deadline management. Ask for a specific response and a clear point of contact.
Free choice of lawyer has legal conditions. Judicial or administrative proceedings and conflicts of interest can be relevant. This is distinct from requesting another internal handler. Kifid’s Appeals Committee has explained that there is no unlimited right to choose an external lawyer for every out-of-court disagreement. Read Kifid’s explanation.
Even where free choice applies, funding still needs attention. Confirm the available budget, work covered and any personal contribution. Permission to contact a lawyer is not necessarily a promise to pay every invoice. Agree the engagement and funding before substantial work begins.
Keep the original dispute under control
Your complaint about the legal expenses provider may run alongside an employment, housing or consumer dispute. The original matter has its own deadlines. Waiting for a coverage decision does not automatically extend a statutory deadline or a date set by the court.
Send the underlying documents as well as the insurance correspondence. Establish who is responsible for each immediate step. If nobody has accepted the engagement, do not assume a deadline is being monitored. State the earliest date at first contact.
Hypothetical example: an employee needs to challenge an employer’s decision while the insurer is still considering cover. The employment position and insurance dispute must be assessed together, including whether an interim arrangement for work and costs is needed. This is an illustration, not a reported case won by our firm. See employment law in Tilburg.
A public judgment: providing documents and a reasonable response period
A public judgment of rechtbank Zeeland-West-Brabant illustrates the importance of practical cooperation. The case was heard in Bergen op Zoom and was not handled by our firm. The insured sought legal assistance over a car purchase. After an initial refusal, he demanded action by the next working day; cover was granted two days later.
The court found that the very short period was not reasonable. The provider had also repeatedly requested the purchase agreement and correspondence needed to assist. There was no relevant procedure yet giving rise to free choice of lawyer. The claims were dismissed: 29 July 2026, Read the published judgment.
The practical point is to provide necessary documents and distinguish genuine urgency from an arbitrary deadline. The outcome of another case does not determine yours. Your policy, the provider’s conduct and the underlying matter still require assessment.
Loss caused by inadequate legal assistance
A missed deadline or incorrect recommendation does not automatically mean the provider must reimburse the entire original claim. We need to establish the alleged error, its consequences and how the case would probably have developed without it. Both the insurance file and underlying legal file matter.
Keep engagement letters, advice, procedural documents and messages recording instructions or deadlines. Explain what you did afterwards to limit the consequences. An unfavourable result may have causes other than the alleged handling error.
Replacement assistance costs, loss of an opportunity and the value of the original dispute are not always the same loss. We discuss which items can be supported and whether an independent assessment is useful. The potential benefit and cost of further work should be proportionate to the case.
Home, contents or motor insurance refuses payment
For a rejected damage claim, determine whether the insurer disputes the insured event, relies on an exclusion, challenges the amount or alleges a late report. Each reason calls for different evidence. Paying premiums does not by itself answer the insurer’s legal reasoning.
Ask for the full calculation and relevant expert reports. Separate repair costs, replacement value, depreciation and the excess. A total offer without supporting detail is hard to compare with your own claim. Preserve original photographs, invoices and reports before repairs remove evidence.
A claim should be reported as soon as reasonably possible and relevant information supplied. The consequences of delayed reporting depend on the legal rules, policy and circumstances; refusal is not automatically justified by delay alone. For an initial assessment, include the first report as well as the latest letter.
Prepare a complaint with a clear request
State the policy and file number, the decision challenged and the remedy sought. Do you want the insurer to resume handling, fund external assistance or compensate a loss? Explain each request separately and attach the most relevant evidence in a logical order.
Ask for a written response addressing the individual points. A complaint about communication is not necessarily a claim for damages. A request to use the dispute-resolution procedure also has its own purpose. Keeping these requests distinct helps avoid an answer that deals with only one part of the problem.
If Kifid is a possible next step, check eligibility and the consequences of the procedure. A binding decision can restrict the scope of a later court challenge. Kifid explains binding and non-binding outcomes. Do not start several routes without considering how they interact.
Complaint periods and limitation are separate
Kifid normally requires you to complain to the financial service provider first. Its regulations address the period after the definitive response and the period after the original complaint. Three months and one year can be relevant, with conditions and exceptions. Have the actual letters and dates checked against the applicable rules. Kifid’s eligibility information.
The limitation period for an insurance payment claim is a separate issue. Article 7:942 of the Dutch Civil Code provides a three-year framework, including rules on written claims and unequivocal rejection; liability insurance can involve different rules. Do not assume that ordinary correspondence preserves every right.
Bring the original claim, all refusals and later communications. A complaint against an intermediary may have a different legal basis and time limit from a claim against the insurer. If a date is close, seek assessment before completing every part of the evidence file.
Business legal expenses insurance
For a business policy, identify the insured entity and activities. A director’s private conflict is not automatically a company dispute. Check which companies or people are covered and whether the relevant activity fits the policy description.
Conditions can concern the financial value, type of contract or geographic scope. Mention acquisitions, changes in activities and communications with the adviser. What was reported and how the insurer responded may matter. Keep offers and advice records as well as the final policy.
Not every business insurance complaint can be taken to Kifid. Eligibility and the court route require separate consideration. Our explanation of refused business legal assistance provides further context.
Tilburg, court allocation and legal costs
Our office is at Kraaivenstraat 38-10, 5048 AB Tilburg. Call 013 747 00 22 for an appointment. The appropriate court depends on the claim, parties and jurisdiction rules, not simply on which office you consult.
Tilburg is within rechtbank Zeeland-West-Brabant. Under its allocation rules, relevant subdistrict cases are handled in Tilburg and commercial civil cases for Tilburg in Breda. Follow the summons and court instructions for the actual venue. A lawyer is not compulsory before the kantonrechter; other civil proceedings may require representation.
The initial assessment is free. Before further work we agree scope and fees, including possible expert and court costs. An insurance dispute with your own insurer is not automatically funded by that insurer. If another legal expenses policy may apply, confirm cover and permission before incurring costs.
Frequently asked questions
Can I always choose an external lawyer?
No. Free choice has legal conditions and must be distinguished from changing an internal handler. A right to choose a lawyer does not automatically mean unlimited reimbursement.
What should I do after a refusal?
Ask for the precise written reason and applicable policy clause. Collect the documents and identify whether the dispute concerns cover, strategy or the quality of assistance.
Does a complaint stop the deadline in my original case?
No automatic suspension should be assumed. The underlying dispute needs separate deadline management. Tell us the earliest relevant date immediately.
Should I use the policy’s second-opinion procedure?
Possibly, if the disagreement falls within its scope. Check the reviewer, required documents, costs and effect of the outcome before requesting it.
Can every business policy dispute go to Kifid?
No. Eligibility depends on the applicable rules, complainant, product and other circumstances. A court procedure may require a separate assessment.
What documents should I send first?
The policy, relevant conditions, refusal and main correspondence. For a handling complaint, include advice and documents from the underlying case. Mention any urgent date.
Is your first assessment free?
Yes. The initial assessment is free. Further work, expert costs and any proceedings are discussed and agreed separately.
