Need quick help?

Do you disagree with a decision about a benefit, a support provision or another government decision? Arslan Advocaten in Utrecht helps assess your legal position and the next steps. We first look at the type of decision, the time limit and the consequences that cannot wait.

From an unclear letter to a concrete legal question

A letter from a government body can contain a lot of information without it being immediately clear what you need to do. Is it an intended decision, a final decision or a decision on an objection? Has only information been requested, or is your entitlement changing? This distinction determines which response is needed. Keep the complete letter and the enclosures.

We look at who took the decision and which legal remedies are available. The right body or court does not follow solely from your place of residence, Utrecht. The type of scheme and the stage of the procedure also count. The passage at the bottom of the decision about objection and appeal is therefore important, but should be checked if in doubt.

Also note when you received the decision and how it was sent. In many administrative law cases, a time limit of six weeks applies, with exceptions. A telephone conversation to ask for an explanation does not automatically preserve that time limit. Have it assessed in good time whether a formal response is needed now while additional information is still being collected.

Lodging an objection with the Municipality of Utrecht

The municipality explains this on its page lodging an objection (bezwaar maken). Check whether your decision falls under that route and which method of submission is permitted. Keep a copy of your objection, the enclosures and the acknowledgement of receipt. With digital submission, a draft in a form is not the same as an objection that has been sent.

State what you want to see changed. For example, a review of a refusal, a different calculation or a fresh investigation of your application. Link each argument to a part of the decision. That makes the objection more than a statement that you disagree with the outcome.

A complaint about how an employee treated you may require a different route. A report about a problem in the neighbourhood is not an objection to a decision either. Where several issues are involved, we discuss which action suits which aim. That prevents a substantive dispute from unintentionally being dealt with only as a complaint.

Support and provisions: what was investigated?

With a decision on support, it matters which need was established and which investigation preceded it. Does the description of your daily functioning match your situation? Which information was taken into account and which alternatives are mentioned? The assessment must fit the decision and the applicable scheme.

Be specific about which tasks or activities you cannot manage, what help is already available and where a shortfall remains. A general feeling that the support is insufficient is harder to assess than an overview of the day-to-day consequences. Ask for the investigation report and check whether factual errors have found their way into it.

With a changed provision, it must also be clear from when the change applies. If there are direct consequences that you cannot absorb, mention them at first contact. A substantive objection and a request for temporary continuation may both need attention at the same time.

Decisions on income and incapacity for work

With a benefit decision, we distinguish between award, amount, discontinuation, recovery and any fine. One letter can contain several decisions. So check exactly which parts you want to challenge and which time limits apply to those parts. Send all enclosures, including calculations that you do not understand yourself.

With UWV, there may be disagreement about medical limitations, jobs considered suitable or the financial calculation. Different documents are needed for each. A medical letter does not automatically answer a vocational assessment question; a wage calculation says little about capacity for work. We help to structure the dispute and determine which additional information is useful.

More information can be found on objecting to a UWV decision and WIA and incapacity for work. Mention whether there is also a dispute with your employer. That is not the same procedure, but it may contain information relevant to your income position.

Building the file without unnecessary noise

A good file contains the decision, the application, relevant requests for information, your answers and the documents on which the decision is based. Arrange these by date. Add a short explanation to documents whose meaning is not immediately apparent. Keep the original files available.

Make a list of disputed facts. For example, a wrong period, incorrect income details or a missing notification. State which document shows the correct information. That makes it possible to assess whether the decision is factually incorrect, insufficiently reasoned or requires further investigation.

A fictitious example: an application is refused because a document is said to be missing, while you have a confirmation that it was submitted. That confirmation helps to reconstruct the course of the procedure. It must then still be assessed whether the substance meets the conditions. A procedural error and a substantive entitlement are different questions.

The hearing and responding to new information

At a hearing, a clear explanation is more important than reading out all previous letters. Prepare the key points and decide which questions you want to ask. If new documents or arguments come up, ask for sufficient opportunity to examine them and respond to them.

Record which commitments were made and which information you still have to provide. Check the agreed time limits. An oral discussion can clarify matters, but for the rest of the file it must remain clear what exactly the parties agreed and which points remain disputed.

Sometimes a solution is offered during consultation. Have the consequences assessed before you withdraw an objection. Has the desired change actually been recorded, when does it take effect and what happens to earlier consequences? Ending a procedure on the basis of an unclear expectation can cause problems later.

Appeal after a decision on the objection

If the objection does not lead to the desired outcome, we examine the new decision and its reasoning. Which arguments were addressed and where does a legal dispute remain? A notice of appeal must be directed at that decision. Simply repeating the original objections is not always enough.

The information from the judiciary (Rechtspraak) on appeals explains the steps. The competent court and the method of filing must be checked for each case. Forward the decision on the objection quickly so that the appeal period can be monitored separately.

We discuss what is at stake, the legal points of departure and the costs. The possible outcome also deserves nuance: a successful appeal may mean that the government body has to take a new decision. That is not always the same as immediately being granted everything that was requested. Your expectations should match what the court can do in those proceedings.

Urgency and failure to take a decision

An objection or appeal does not usually stop a decision from being implemented. If the consequences threaten to be irreversible or very far-reaching, a provisional measure can be considered. State specifically what is happening, on what date and why the main proceedings cannot be awaited. Evidence of urgency is important.

A request for a provisional measure is linked to pending objection or appeal proceedings. The judiciary (Rechtspraak) describes this urgent procedure. A request does not automatically lead to suspension; the court assesses the conditions and interests involved.

When the government body fails to take a decision at all, a different question arises. The decision period, any extension and the applicable scheme must be checked. Sometimes a notice of default and further proceedings are possible, but not every delay automatically gives entitlement to a penalty payment. Keep the confirmation of your application and any messages about postponement.

Costs and contact in Utrecht

For an initial assessment, the complete decision, the date of receipt and a short description of the problem are enough to determine the urgency. We then agree which documents are still needed and which work will be carried out. If a time limit is approaching, you do not have to wait for a perfectly organised file.

We discuss fees, possible funding and external costs. Subsidised legal aid (toevoeging) is subject to conditions. Even if you are successful, reimbursement of all actual lawyer’s fees is not a given. Awards of legal costs follow their own rules and may be lower than the costs incurred. That should be taken into account when choosing whether to start proceedings.

Frequently asked questions about administrative law in Utrecht

Can I lodge an objection without all the supporting evidence?

Sometimes an initial objection can be lodged and supplemented later, but the requirements and time limits must be checked. If time is short, do not wait until every document is available.

My application is not being dealt with. Is an objection the right step?

That depends on what has happened and which decision period applies. A failure to decide in time may require a different route from an objection to a substantive decision.

Can you help with a WIA decision?

Yes, we can assess which medical, vocational or financial aspects are disputed and which documents are needed for an appropriate approach.

Does my case always have to go to the court in Utrecht?

No. The competent court depends on the type of decision and the statutory rules. Your place of residence alone does not determine this in every case.

What should I send in an urgent case?

The decision, the relevant date and evidence of the direct consequences. Describe why waiting for the normal procedure does not help enough, so that the urgency and possible routes can be assessed.
