Work accident lawyer costs in the Netherlands

Workplace accidents in the Netherlands · Employer liability

The first conversation with Arslan Advocaten is free and without obligation. Further representation is a separate instruction. If another party is liable, reasonable out-of-court legal costs may be recoverable from that party. This does not mean that every accident claim or court case is automatically free.

Which legal fees can be recovered?

Article 6:96(2) of the Dutch Civil Code allows recovery of certain reasonable costs of establishing liability and damage and obtaining payment outside court. Both engaging assistance and the amount charged must be reasonable. The work must also relate to the accident and the relevant claim.

An insurer’s acceptance of liability does not mean it must pay every hour, every hourly rate or every expert invoice. Necessary work, complexity, duplication and proportionality can still be disputed. Ask how a disagreement over fees would affect you before giving an instruction.

What to agree in writing

Subject Question to ask
Scope Is this a first assessment, a second opinion or full representation?
Fees What rates, VAT and other charges apply?
Recovery Who pays if liability or the legal invoice is disputed?
External assistance Will medical advice, translation or an expert report need a separate budget?
Proceedings Are court work, court fees and adverse costs included or separate?
Ending the instruction What is payable if the case is stopped or transferred?

If liability is disputed or no insurer is known

The chance of recovering costs is less certain when the facts, employer’s liability or available cover are disputed. Start with a proportionate assessment of the accident, the relevant parties and the evidence. It may be sensible to agree on a limited first phase before commissioning extensive expert work.

No insurance does not automatically mean there is no liable party, but actual recovery may be difficult if that party cannot pay. Discuss this practical risk as well as the legal merits.

Medical advice and other expert costs

A medical adviser may assess the connection between the accident and your limitations. An occupational expert may examine work capacity or return to work; a financial expert may calculate future income loss. They have different roles. Their involvement is not mandatory in every case.

Ask why the proposed work is needed, who commissions it, how the price is determined and whether insurer approval is being sought. Where MEDICA Medisch Advies is involved, the medical instruction and cost arrangements should be clear before information is requested.

Court costs follow different rules

Ordinary civil proceedings can involve your own lawyer’s fees, court fees, expert costs and a possible costs order. A successful party generally does not recover its complete lawyer’s invoice through the standard court costs award. The relationship between out-of-court work and litigation costs also matters.

A personal injury partial dispute procedure has a specific cost assessment under article 1019aa of the Code of Civil Procedure. That is not a blanket promise of free litigation or payment regardless of liability. Have the proposed procedure and financial consequences explained first.

Legal expenses insurance and subsidised legal aid

Tell us if you have legal expenses insurance. Check coverage, reporting requirements, any deductible and the insurer’s conditions before commissioning work. The statutory right to choose your own lawyer applies in particular situations, including relevant judicial or administrative proceedings or a conflict of interest; it is not an unlimited right to have every outside instruction funded.

Subsidised legal aid may sometimes be available, subject to the Legal Aid Board’s criteria, your means and the type of case. An own contribution and other charges may still apply. Do not assume eligibility before it has been assessed.

Can I keep an advance on my compensation?

An advance towards your injury losses is different from an agreement about legal costs. Ask for a clear distinction between money paid for your damage and money paid towards representation. Do not rely on a compensation advance as proof that all future fees are covered.

Legal, employment and medical questions in one case

Arslan Advocaten combines personal injury lawyers, legal advisers and NIVRE registered experts. Our employment law specialists can assess wage payment, suitable work and employment termination alongside the injury claim. Where medical assessment is needed, we work with MEDICA Medisch Advies. Its role is to assess the medical information and consequences; it does not decide legal liability or replace your treating doctor or occupational physician.

We discuss the instruction, costs and necessary consent before obtaining medical information. Send medical records through the agreed secure route, not to your employer or in a public form. The first conversation is free and without obligation. The costs of further work are agreed separately.

Call +31 70 450 0300 to discuss your situation. Have the accident date, employment details and any insurer correspondence ready.
