Work accident settlement: check before signing

Workplace accidents in the Netherlands · Employer liability

A settlement can end a workplace injury claim permanently. Before signing, check not only the amount but also which claims you give up, what happens if your health or income changes and when payment is due. A personal injury settlement and an agreement ending your employment have different purposes and rules.

What does the agreement settle?

A Dutch settlement agreement, a vaststellingsovereenkomst, is governed by article 7:900 of the Civil Code. Identify the accident, the parties, the insurer and the claims covered. Check whether the text also addresses wages, employment termination, benefits or another dispute.

Article 7:902 can, within limits, allow parties to settle an existing uncertainty or dispute even where the settlement differs from mandatory law. It is not a general permission to waive mandatory protection in advance. The exact wording and context matter.

Check each component of the compensation

  • Past and future loss of earnings, pension loss and realistic career assumptions.
  • Treatment expenses, travel costs and other documented expenditure.
  • Household assistance, personal care and help you will still need.
  • Pain and suffering and any other relevant loss.
  • Advances already paid, interest, legal fees and the remaining balance.

Compare the proposed figures with an itemised loss schedule. A single total can conceal that future losses have not been calculated or that previously paid advances are being deducted twice.

Is the medical position clear enough?

A medically stable situation does not necessarily mean full recovery. Lasting limitations may affect your work, care needs and ability to manage at home. If prognosis is uncertain, ask whether final settlement is appropriate now.

With the necessary consent and agreed instruction, a medical adviser can help assess the prognosis and missing information. MEDICA’s advice supports the medical assessment; it does not decide the settlement for you or guarantee the insurer will accept a particular amount.

Final release and reservations for future damage

A final release, often called finale kwijting, may close claims for unknown future consequences as well as known damage. Read the scope carefully. If a future risk is reserved, describe the event or deterioration, the losses covered, applicable time limits, evidence requirements and the process for reopening the claim.

A vague sentence saying that you can come back if things worsen may be inadequate. Conversely, a broad release elsewhere in the document may undermine what you thought had been reserved. The whole agreement must be read together.

Does employment also end?

Have an employment law specialist assess any clause affecting your job, wages or benefits. Do not assume that your personal injury settlement automatically carries the cooling-off period for termination by mutual consent. A written employment termination agreement ordinarily has a 14-day statutory withdrawal period, extended to 21 days if the employer does not provide the required written notice of that right. Those rules do not automatically apply to a separate injury settlement.

Ending employment during sickness can also affect benefit rights. The injury compensation amount alone does not resolve that issue.

Check payment and practical obligations

Confirm the payment deadline, account, treatment of interest and costs, and what must happen before payment. Review confidentiality, repayment, indemnity and set-off provisions. Keep the complete signed version and all documents incorporated by reference.

If immediate financial pressure is the reason for accepting, discuss whether a supported request for an advance is possible while disputed or future losses remain open. An advance is not guaranteed.

Can a signed agreement be reopened?

Only in limited circumstances. Rules on mistake and the restrictive effect of reasonableness and fairness may be relevant, but the threshold and the settlement’s purpose matter. Do not sign on the assumption that a court will later correct an unfavourable outcome. Obtain advice before acceptance, including before an email that could itself conclude an agreement.

Legal, employment and medical questions in one case

Arslan Advocaten combines personal injury lawyers, legal advisers and NIVRE registered experts. Our employment law specialists can assess wage payment, suitable work and employment termination alongside the injury claim. Where medical assessment is needed, we work with MEDICA Medisch Advies. Its role is to assess the medical information and consequences; it does not decide legal liability or replace your treating doctor or occupational physician.

We discuss the instruction, costs and necessary consent before obtaining medical information. Send medical records through the agreed secure route, not to your employer or in a public form. The first conversation is free and without obligation. The costs of further work are agreed separately.

Call +31 70 450 0300 to discuss your situation. Have the accident date, employment details and any insurer correspondence ready.
