On-call work, cancelled shifts or an internship dispute
You work regularly but have little certainty about hours, a shift is cancelled or an internship increasingly resembles ordinary employment. The label on the contract is only part of the assessment. Arslan Advocaten assists clients from Nijmegen through its Eindhoven office, including questions about part-time jobs and flexible work.
Record how the relationship works in practice
Collect the contract and annexes and identify who gives instructions, pays you and is named as the employer. For an internship, add the learning objectives, supervision arrangements, evaluations and correspondence with the educational institution. Describe an ordinary working week. The tasks and responsibilities help distinguish the actual dispute from the wording on the agreement.
Keep the original roster as well as changes
Save each call to work, later amendment or cancellation with its date and time. Compare scheduled and worked hours with the payslips. For questions about a stable number of hours, a longer series of records may be needed; note holiday, illness and exceptional peaks. An agreement about guaranteed hours and an indefinite-term contract are separate questions.
No further shifts, illness or an exit proposal
The absence of new shifts does not by itself establish that the contract has legally ended or that no wages are due. Ask for a written explanation and keep messages about your availability. Report illness through the agreed procedure and have any proposal to leave during illness assessed before signing. If there is a dismissal or legal deadline, mention it immediately; informal discussions do not automatically protect it.
