After storm or water damage, an insurer may acknowledge the weather event but say the building’s condition caused the loss. A business insurer may rely on an exclusion or a description of insured activities. Arslan Advocaten helps identify the actual disagreement and the evidence needed for a response.

Our Rotterdam office assesses policy cover, damage calculations and the role of an intermediary where relevant. Send the applicable conditions and refusal, together with available reports. Tell us if repairs, demolition or a legal deadline could affect the next step.

Tell us immediately about any complaint, response or court deadline. An enquiry does not itself create an engagement or extend a deadline.

Start with the policy and the disputed cause

The policy schedule, conditions and specific clauses are the starting point. Determine whether the insurer disputes the event, relies on a defect or exclusion, or challenges the amount. A repair estimate does not by itself establish cover, and recognising a storm does not automatically resolve every causal question.

Article 7:951 of the Dutch Civil Code addresses damage caused by the nature or a defect of the insured object, but policy conditions can alter the relevant cover. Where several causes contribute, the contractual wording and applicable causation approach require assessment. Do not assume a single label settles the issue.

Ask the insurer to explain how its chosen provision applies to the facts. Which report supports the conclusion, and what was actually investigated? Our guides address refused water damage and property insurance during changed use.

Preserve evidence from the first stage

The condition immediately after damage may not be available for later inspection. Record what you found, when and who was present. Take overview and detail photographs where possible, preserve originals and explain the location. Images without context can be difficult to interpret.

Safety and necessary measures come first. Record emergency work and why waiting was not reasonable. Ask the contractor to separate observations about the cause from the proposed repair. A conclusion that a component needs replacing is not automatically an explanation of why it failed.

Evidence of the earlier condition also matters: maintenance invoices, inspections, old photographs and previous reports. Be accurate about known defects. The question is how the condition and insured event affect entitlement under the policy, not whether an inconvenient fact can be omitted.

Read the expert’s instructions as well as the conclusion

An expert may investigate cause, damage extent or repair cost. Check the precise task and whether the report answers the relevant questions. A valuation is not the same as a legal interpretation of an exclusion. The insurer should explain how the findings support its coverage decision.

Identify specific objections. Was a component overlooked, an incorrect maintenance date used or another possible cause left unexplored? Refer to supporting material. A general statement that a building was well maintained is different from recent inspections with measurements and photographs.

A counter-expert can help if the investigation addresses the unresolved questions. Agree who instructs the expert, the scope and funding before commissioning work. Reimbursement is not automatic simply because you disagree with the first report. Read more about counter-expertise in an insurance dispute.

Public judgment: storm Eunice and a defective structure

A public Rotterdam judgment concerned the collapse of a vacant farmhouse roof during storm Eunice in February 2022. The existence of a storm within the policy definition was accepted. The insurers relied on a defect and their expert’s findings about deterioration from inadequate maintenance. This was not our firm’s case.

The owner relied on an earlier building inspection. The court questioned that report and found the defective structure to be the dominant cause. The claim was dismissed and the owner was ordered to pay procedural costs: 27 May 2026, Read the published judgment.

The example shows why early evidence and a properly focused response to expert findings matter. It is not a rule that storm damage to every older building is excluded. Your contract, condition and evidence require individual assessment.

Separate repair, improvement and business interruption

A quotation can combine repair of the event’s damage, replacement, ordinary maintenance and improvement. Ask for a breakdown. Comparing only the total may hide where the real disagreement lies. The applicable valuation basis can also differ from the cost of a completely new replacement.

For a business, lost revenue or interruption may arise alongside physical damage. Cover and calculation depend on the relevant insurance. A payment for a damaged asset does not automatically settle the company’s interruption claim. Collect revenue information, fixed costs, the repair timeline and measures to continue operating.

Saved expenses, temporary premises and lost income are different items. Financial records should correspond with the insured period and method. An accountant or other expert may help, but scope and cost need attention. Identify which part of the disagreement is legal and which concerns the figures.

Vacancy, letting or renovation after the policy began

A property’s use may change: it becomes vacant, a room is let or renovation starts. Check what the policy requires and what was communicated to the insurer or adviser. Keep the relevant messages and responses alongside the policy versions.

The content of the notification matters. Saying that “some work” is being done may not describe a substantial renovation. Equally, a written confirmation of continuing cover can be important. The issue should be assessed from the full exchange rather than the latest policy document alone.

The intermediary’s role may require separate examination. Lack of cover does not automatically establish negligent advice. We consider the adviser’s duties, information received and any loss caused by an error. An insurance claim and an adviser claim should be coordinated without prematurely accepting either party’s position.

Business liability: the third party’s claim and your cover

Identify who is being held liable: you personally, a company or another party. What activities and period are involved? The insured capacity and applicable terms can affect cover. Send the liability letter, contract and relevant correspondence according to the policy requirements.

Do not make binding admissions or agree full compensation without considering the insurance consequences. Practical measures may still be necessary; document their purpose and circumstances. The response to the claimant and the claim for cover should remain consistent.

Ask what a reservation of rights means in practice. Is the insurer investigating, seeking information or already relying on an exclusion? Deadlines in the liability dispute continue while cover is discussed. See our explanation of refused liability insurance cover.

An advance or settlement needs clear terms

If part of the loss is established, payment of that part may be discussed while other issues remain open. An advance is not an automatic entitlement in every case. Explain the basis, supporting documents and why the whole file need not be resolved first.

Read an offer carefully. Is it an advance, final payment or payment in return for full release? Does it include expert costs, interest and uncertain future items? An amount that helps immediately may involve giving up broader rights than expected.

If financial consequences are acute, provide concrete information about repairs, obligations and resources. Urgent proceedings have their own requirements and risks. Negotiation, further evidence and litigation should be assessed as separate options. The written terms of a settlement need to reflect what remains open.

Complaint periods and preservation of claims

Article 7:942 of the Dutch Civil Code contains limitation rules for insurance payment claims, including a three-year framework and provisions on written claims and unequivocal rejection. Liability insurance can involve different rules. Identify the specific claim before assuming which period applies.

Kifid normally requires an initial complaint to the service provider. Eligibility and filing periods must be checked against the applicable regulations and actual correspondence. The periods following a definitive response and the first complaint can both matter. Kifid’s information gives the general conditions.

An internal discussion does not automatically preserve every right against an insurer or intermediary. Send early reports and refusals as well as recent letters. State an approaching date before waiting for a complete technical or financial file.

Rotterdam and the appropriate forum

Our office is at Schiedamsedijk 60-A, 3011 EH Rotterdam. Call 010 311 55 00 to arrange an appointment. Jurisdiction depends on the parties, claim and applicable rules, not only on your address or the office you consult.

Rotterdam has a district court with subdistrict and other civil proceedings. A lawyer is not mandatory before the kantonrechter; larger or other civil claims may require representation. The summons and court instructions determine the hearing venue. Kifid is a national option only where its conditions are satisfied; health-insurance complaints may involve SKGZ.

Before selecting a complaints or court route, consider the remedy, evidence and possible binding effect. Kifid explains binding and non-binding outcomes. Not every business insurance dispute is eligible for Kifid.

Insurance dispute or personal injury claim?

A disagreement with your own insurer differs from claiming bodily injury compensation from a responsible third party. Both may follow one accident, but the legal bases and applicable conditions differ. State which parties and policies are involved.

Where there is overlap, identify payments already made and what they cover. The same loss cannot simply be recovered twice without considering the legal relationship between payments. Consistent information helps prevent a statement made in one file causing confusion in another.

For an injury following an accident, see personal injury assistance in Rotterdam. At the first assessment, we determine which questions belong to the insurance dispute and which require a separate liability analysis.

Preparing the first assessment and agreeing costs

Send the schedule, conditions, refusal and main reports. For property damage, include use, maintenance and changes. For a business policy, identify the exact insured entity. Add a short explanation of the result sought and a timeline.

Mention scheduled repairs or demolition that could change evidence. List missing documents and who holds them. For a disputed amount, a simple table of claimed, allowed and outstanding items helps identify the next useful step.

The initial assessment is free. Further work, experts and procedural costs are agreed separately. A dispute against your own insurer is not automatically funded by that insurer. We discuss scope and possible conflicts before accepting an engagement; sending documents alone does not mean a deadline is being monitored.

Frequently asked questions

Is storm damage automatically covered?

No. The event, causes, insured object and applicable conditions need assessment. Recognition of storm conditions does not resolve every exclusion or valuation issue.

What if the insurer blames maintenance?

Request the full report and precise policy basis. Collect earlier inspections, photographs and maintenance records. A focused counter-expert assessment may be useful.

Who pays for a counter-expert?

That depends on the policy, applicable rules and the scope and reasonableness of costs. Discuss funding before commissioning the work.

Can repairs begin before the decision?

Safety and necessary measures may require action. Preserve evidence and discuss inspection where possible. Clarify whether any permission also addresses cover or costs.

Does payment for the building settle interruption losses?

Not automatically. Business interruption can have separate cover, periods and calculations. Identify the relevant policy and financial records.

Could my adviser be responsible for unsuitable cover?

Possibly, but lack of cover alone does not prove a breach. The advice, information supplied, duties and resulting loss need investigation.

Does an advance close the claim?

That depends on the written terms. Distinguish an advance from final settlement and review any release of remaining rights.
