Need quick help?

An insurer may say you reported damage too late, supplied insufficient information or exceeded the policy limit. Arslan Advocaten helps assess what that reasoning means for your claim. We start with the applicable policy, evidence and full correspondence, not just the final amount offered.

From our Utrecht office, we discuss whether a targeted response, further evidence, complaint or proceedings are appropriate. Tell us immediately about a response date, a summons or urgent consequences. A continuing conversation with an insurer does not automatically protect every right.

Separate the report, supporting information and payment claim

You may initially report an event, provide a damage schedule later and then challenge a refusal. These messages can have different legal significance. Record the date, recipient and content of each. Include a report made through an adviser as well as correspondence directly with the insurer.

Keep copies of forms, acknowledgements and account messages. A note of a telephone call can help, but a written confirmation may better establish what was said. If no confirmation is available, identify the records that still exist instead of assuming the report cannot be proved.

When correcting or supplementing information, distinguish a mistake from something discovered later. Preserve the original documents. A separate explanation of what changed and why keeps the history clear and avoids fresh uncertainty about the reliability of the file.

What does a late report actually prevent the insurer from doing?

Article 7:941 of the Dutch Civil Code concerns prompt reporting and provision of relevant information. The consequences of non-compliance depend on the law, policy and circumstances. A late report does not automatically justify complete refusal in every case.

Ask what prejudice the insurer alleges. Was an object unavailable for inspection, could the cause no longer be established, or was an opportunity to recover from another party lost? The explanation should relate to the policy provision being applied. A general statement that the claim was late may leave important questions unanswered.

Identify evidence still available: early photographs, repair notes, witness details, a police report or messages to a building manager. Explain the reason for delay without assuming every understandable reason removes the legal consequences. Our guide addresses damage reported late to an insurer.

A public Utrecht-area case: late reporting and robbery

A policyholder was robbed while selling an expensive watch. The police report followed after ten days and the intermediary notified the insurer after three and a half weeks. The insurer refused payment, alleging prejudice from those delays. This public case was not handled by our firm.

The subdistrict court found the alleged prejudice insufficiently explained, but applied the policy limit. The insurer was ordered to pay €7,500 plus interest and costs; the insured therefore succeeded only in part. The decision is dated 22 April 2026: Read the published judgment.

The intermediary’s delay was attributed to the insured. Check that your notification actually reaches the insurer. The case does not establish that every delayed claim must be paid: the policy, available evidence and specific prejudice still require assessment.

Theft: establish the event, ownership and value

A theft claim can raise several separate questions: what happened, which items were present and what they were worth. A police report is important but does not automatically establish every item or amount. Organise the evidence by question.

Purchase records, bank payments, photographs, guarantees or valuations may support ownership and value. If a receipt is missing, explain what genuine alternative evidence is available. Never substitute a document for a different item as though it proved the claimed property. Label estimated figures clearly.

Check special policy limits for categories such as jewellery, electronics or possessions away from home. The overall insured amount is not necessarily the limit for each category. See our explanation of refused burglary damage. Request the relevant clauses and calculation if payment is restricted.

Policy maximum, excess and valuation are different calculations

An insurer may apply a limit per event, per item or per category. Ask how the loss has been classified and which clause supports that approach. If several events are treated as one, that grouping may also need examination. The number of claim notifications does not necessarily determine the number of insured events.

The excess, depreciation and valuation basis may affect the amount as well. Replacement value, current value and repair costs are different concepts. A quotation for a completely new replacement is not automatically the policy entitlement, but the insurer should explain a lower valuation.

Prepare a comparison for each item: amount claimed, amount allowed, difference and stated reason. This distinguishes a few omitted invoices from a fundamental dispute over the calculation method. The evidence needed will differ between those situations.

Repairs while the insurer is still investigating

Sometimes prompt work is needed to prevent further harm. At the same time, the damaged condition may be important evidence. Record what you found, who inspected it and why particular work was necessary. Where possible, discuss inspection before components are removed.

Keep photographs before, during and after work, quotations, invoices and the contractor’s observations. Separate emergency measures, repair of the event’s damage and improvement or ordinary maintenance. A combined bill may make it difficult to establish which costs relate to the claim.

Permission to carry out work is not necessarily acceptance of cover or of every cost. Confirm the scope of any agreement in writing. Equally, an insurer’s reservation does not mean necessary safety measures can always wait. Safety, limiting further loss and preserving evidence need a practical assessment.

Motor and travel incidents: identify the relevant insurance

One incident can involve several policies. Establish whether the claim concerns your own property, another party’s liability, assistance services or additional cover. Each can have different conditions and notification requirements. A single case number does not mean every part of the loss has the same basis.

For motor damage, the accident form, photographs, statements and first repair findings may matter. Identify whether cause, liability or amount is disputed. The opposing party’s position is not automatically a decision by your own insurer. Our motor insurance dispute guide explains related issues.

For an incident during travel, keep trip records, local reports and contact with assistance providers. Preserve foreign-language originals and label translations. Explain which expenses were necessary and what commitments were made. This helps separate the factual history from assumptions about reimbursement.

Write a response that addresses the actual refusal

Specify what should be reconsidered. Is the event described incorrectly, has evidence been overlooked or is a policy maximum misapplied? Address those points individually. The understandable argument that you have always paid premiums usually does not answer the insurer’s stated legal reasoning.

Attach relevant documents and show how they support each point. Ask for a written explanation if it is missing. If the insurer adds a new reason, further evidence or a different response may be needed. Retain earlier versions of its position.

State the result sought: an additional payment, a fresh assessment or correction of recorded information. A clear request helps avoid an answer addressing only part of the dispute. Any further route should be considered in light of the remedy you actually need.

Internal complaint, Kifid and civil limitation

Kifid is a national complaints body for eligible disputes. You generally need to complain to the financial service provider first. The provider, product, prior proceedings and timing all matter. Check Kifid’s eligibility information before assuming the complaint can be accepted.

The periods following a definitive response and the original complaint are distinct from limitation of a civil claim. Article 7:942 of the Dutch Civil Code contains rules for insurance payment claims, including written claims and unequivocal rejection; different rules can apply to liability insurance. Ordinary correspondence should not be assumed to preserve every right.

Send the earliest notification and refusal as well as later letters. A claim against an intermediary can have a different basis from a claim against an insurer. If a deadline is approaching, assessment should not wait until every invoice has been collected.

A final settlement and remaining uncertainty

A proposed payment may be an advance or a final settlement. Clarify which event, period and items it covers. Are interest, expert costs and later consequences included? A final-release clause can affect more than the immediate amount being discussed.

Where damage remains uncertain, identify what still needs investigation. The written agreement should reflect which rights remain open. An informal assurance is not a substitute for clear terms. Similarly, a binding Kifid outcome can have consequences for a later court challenge. Kifid explains the distinction.

We consider further evidence, negotiation and proceedings as different options. The appropriate choice depends on the value of the case, evidence, urgency and cost. No outcome can be promised before the actual file is assessed.

Our Utrecht office, court and preparation

The office address is Atoomweg 63, 3542 AA Utrecht. Call 030 747 00 38 to discuss an appointment. Prepare the policy schedule, relevant conditions, latest decision, a short timeline and a table of disputed amounts. Tell us which documents are still missing.

Utrecht is within rechtbank Midden-Nederland. Jurisdiction and allocation depend on the case, parties and applicable rules, not solely on where you live or consult a lawyer. Follow court documents for the hearing location. A lawyer is not compulsory before the kantonrechter; other civil proceedings may require representation.

The first assessment is free. Further correspondence, experts and proceedings are discussed separately. Another legal expenses policy may be relevant, but cover and permission should be confirmed before costs are incurred. Contacting the office does not by itself mean a deadline is being monitored.

Frequently asked questions

Does a late report always mean no payment?

No. The applicable rules, policy, circumstances and claimed prejudice must be assessed. Send the reporting history and evidence still available.

What if I reported the event by telephone?

Preserve call notes, confirmations and account messages. Explain when you called, whom you spoke to and what was reported. Missing written confirmation does not answer every evidential question.

Is the overall insured amount the limit for every item?

Not necessarily. Policies can have category or event limits and a particular valuation basis. Ask for the exact clause and calculation.

Should repairs wait until the insurer decides?

Safety and necessary measures may require action. Preserve evidence and discuss inspection where possible. Permission for repairs and acceptance of cover are different matters.

Can I claim stolen items without receipts?

The available genuine evidence must be assessed. Photographs, payments and other records may help. Do not replace missing evidence with documents for another item.

Does an internal complaint stop limitation?

Do not assume it does. The claim, wording of correspondence and applicable time rules need separate assessment.

Can I take any insurance dispute to Kifid?

No. Eligibility and timely filing must be checked. The appropriate court or another complaints body may be relevant depending on the insurance.
