Negative BKR registration due to a phone provider or private lease – what now?

A BKR registration by a telecom provider or private lease sounds harmless, but the consequences are often significant. You cannot take out a mortgage, a loan is refused, and even renting a home becomes difficult. Many consumers do not know that they can object to this. This blog explains what your rights are and how you can have the registration removed or shortened.

Why do you get a BKR registration from a phone provider?

Since 2017, mobile phone subscriptions with device credit of more than €250 are formally loans. Providers such as KPN, Vodafone, T-Mobile or Hollandsnieuwe are therefore obliged to report these loans to the Bureau Krediet Registratie (BKR). If a payment arrears arises, a negative registration (A-coding) follows. That notice then remains visible for five years – even if the arrears are later cleared.

Private lease and BKR registrations

With private lease the risk is similar. The monthly lease price is considered a credit obligation. The leasing company registers this with the BKR and can immediately make a negative report in the event of payment arrears. As a result, it becomes much harder to take out a mortgage or loan later.

When is the registration unjustified or disproportionate?

In many cases, a registration is not justified or is too severe. Consider:

  • the provider made a mistake in processing your payment;
  • the arrears were small or only temporary;
  • you cleared the arrears a long time ago;
  • the registration seriously hinders you, for example when buying a home;
  • the provider has not assessed your situation individually.

In such situations the registration may be contrary to the GDPR and the principle of proportionality. That means that the telecom provider or leasing company must weigh your interest against their interest in maintaining the registration.

What are your rights regarding an unjustified registration?

  • You have the right to access your BKR data via bkr.nl.
  • You can submit a request for correction with the provider or leasing company.
  • You can submit a removal request submit if the registration is no longer proportionate.
  • You have the right to a reasoned decision on your request.

How can you have a negative BKR-registration removed?

1. Request your data

Via bkr.nl you can request your report free of charge. Check whether the registration is correct and who placed it.

2. Submit a request to the provider or leasing company

Write a substantiated letter explaining why the registration is incorrect or disproportionate. Attach proof of payment and other relevant documents. Keep it professional and clear.

3. Escalate if rejected

If your request is rejected, you can file a complaint with the Financial Services Complaints Institute (KiFiD) or seek removal through the courts. In many cases it is then decided that the registration must be removed or shortened.
