Renting with housemates in Delft can raise questions about who is liable, whether a replacement needs consent and how the deposit is divided. Arslan Advocaten assists clients from Delft through its office in The Hague. We assess the full agreement and the proposed change before you commit.

Sharing a home does not always mean sharing one tenancy

In Delft, a room, a shared house and a jointly rented apartment can involve different contracts. Check who signed, who pays whom and which facilities are private or shared. Registration at the address does not itself make a resident a contractual tenant. An arrangement between housemates does not automatically change the landlord’s rights.

A housemate leaves or a replacement arrives

A departing resident may remain liable until the change is properly agreed. Check whether the landlord must consent and whether the document continues the existing tenancy or creates a new one. Read more than the names: the rent, liability, deposit and termination clauses may also change. Record existing damage and the deposit balance at the handover.

Room rent and shared service charges

A room uses a different points assessment from a self-contained dwelling. Establish the actual facilities rather than relying on the word studio in an advertisement. Separate basic rent from advances. For a shared energy bill, check meter readings, your period of occupation, the allocation method and payments already made. A previous housemate’s contribution does not prove your own bill is correct.

Repairs, notice and the final handover

Notify defects in writing and explain how shared areas are affected. If the landlord sells, returns to the home or asks you to sign a departure agreement, have the legal basis assessed before accepting a moving date. Preserve the check-in report, final inspection, photographs and key receipt. A municipal report or rent-team enquiry does not suspend a court deadline.

Documents for the first assessment

  • The full tenancy agreement and amendments
  • The landlord’s latest letter, email or summons
  • Payment records, service-charge statements and the deposit proof
  • Inspection reports and dated photographs
  • A short timeline, your desired outcome and the next deadline

How your case is handled

We first identify the tenancy, parties, evidence and urgency. We then discuss whether a targeted letter, negotiation, the Rent Tribunal or court proceedings fits the problem. An application to a municipality and a private claim can require separate action. We agree the scope before further work and explain which documents are still needed. Clients from Delft are assisted through our Den Haag office; this page describes our service area, not an additional office in Delft.

Costs and legal aid

The first consultation is free and without obligation. We assess whether subsidised legal aid (toevoeging) or legal expenses insurance is available. Legal aid can leave a personal contribution and other costs. Otherwise we agree private fees in writing. For a deposit recovery claim, a separate fixed stage schedule applies where accepted; court fees and bailiff costs are explained before the relevant step. A suitable collection claim can also be assessed for separately agreed no cure no pay terms.

Fixed deposit recovery fees, including VAT

Questions before contacting us

Do you have an office in Delft?

We assist clients from Delft through Den Haag. Ask about the practical arrangements for discussing documents before travelling.

Can I contact you before the file is complete?

Yes. Send the agreement and the urgent letter first, particularly if a hearing or eviction date has been mentioned. Further documents can follow.

Does contacting a lawyer stop a deadline?

No. State the deadline immediately. Contact alone does not suspend a notice period or court deadline.
