Car insurance refused because of a CIS or EVR entry: what now?

Short answer. If your car insurance application is refused, the first question is which entry is causing the refusal. A cancellation of the policy (royement) for non-payment, an ordinary claim report and an EVR registration for fraud are three different things, with different retention periods and different routes to a solution. Insurers are under no obligation to accept you. If the entry is justified, the safety-net insurer De Vereende (a Dutch insurer of last resort) is often the practical way out. If the registration is unjustified or too long, challenging it is the route that actually solves the problem.

First establish: which entry is blocking your application?

Can an insurer simply refuse you?

There is no obligation to accept applicants for car insurance. An insurer may refuse an application, even without giving detailed reasons. That feels unfair, but it is the starting point.

Two things do matter, however. First, under the Motor Vehicles Liability Insurance Act (WAM) you are required to keep your vehicle insured for as long as it is registered in your name. Leaving it uninsured results in a fine and, if damage occurs, recovery of the costs by the Dutch Motor Insurers’ Guarantee Fund (Waarborgfonds Motorverkeer). Suspending the registration with the RDW, the Dutch vehicle authority, or transferring the registration can temporarily remove that obligation; that is an emergency measure, not a solution.

Second, a refusal based on a registration says nothing about whether that registration is lawful. The registration may be unlawful, and if it is removed, the ground for refusal disappears with it.

De Vereende as a safety net

If you fall outside the acceptance criteria of regular insurers, you can in many cases turn to De Vereende, the Dutch safety-net insurer. De Vereende itself explains that it takes a tailored approach to applications from people with an EVR registration: it investigates the reason for the registration, asks the registering company what happened, and then assesses whether cover is possible and on what terms.

What you need to know:

  • handling takes longer than an ordinary application, because enquiries have to be made with other insurers;
  • if you have registrations from several companies, it will take correspondingly longer;
  • the premium is generally considerably higher than with a regular insurer;
  • acceptance is not automatic; it remains an individual assessment.

This is a practical way out if the registration is justified. It is not a substitute for challenging a registration that is flawed: as long as the registration stands, you will keep bearing the consequences with every subsequent application, with your mortgage and sometimes at work.

When challenging the registration makes sense

An EVR registration may only be made if all the conditions of Article 5.2.1 of PIFI 2026 (the Dutch financial institutions’ incident warning protocol) are met: the conduct must pose a threat to the interests of the sector or its customers, your involvement must be sufficiently established, and the registration must be proportionate. Where criminal offences are involved, a report to the police is in principle filed.

In addition, the duration is also tested against the principle of proportionality (Articles 4.3.3 and 5.3.2 PIFI). Eight years is a maximum. If removal is not achievable, a shorter period often is, and in practice that saves years during which you are insurable again.

A cancellation of the policy for non-payment is a different matter: what helps there is not a legal defence but removing the cause. Pay the arrears, ask for written confirmation that the claim has been settled, and ask the insurer to amend the registration if its basis has ceased to exist. What you can do now

  • Ask for a written explanation of the refusal: which entry, made by which party, on which date.
  • Submit an access request to Stichting CIS and to the insurer that made the entry.
  • In the meantime, make sure you are not driving uninsured: suspend the registration with the RDW if you are not using the vehicle.
  • Have it assessed whether the registration passes the test of Article 5.2.1 and whether its duration has been substantiated.
  • At the same time, request a quote from De Vereende, so that you are not left stranded while the request is pending.

Frequently asked questions

My partner cannot get insurance either. Is that because of my registration?

A registration is recorded in the name of the registered person. Even so, someone in your household may be affected by it, for example because the insurer asks who the regular driver is or at which address the vehicle is kept. In that case, find out exactly on what ground your partner’s application was refused and whether data about you were used; the latter is processing of your data about which you can ask questions.

Can I register the car in someone else’s name?

That does not solve the problem and may make it worse. If you remain the actual driver while someone else acts as the policyholder, this may, in the event of a claim, be treated as withholding relevant information. That touches on the duty of disclosure under Article 7:928 of the Dutch Civil Code (BW) and may lead to the claim being rejected and, in the worst case, to a new registration.

How long will it take before I can get insured normally again?

That depends on the entry. For non-payment, three years from the reference date; for a cancellation of the policy or a claim report, five years; for an EVR registration, a maximum of eight years. If the duration of an EVR registration is shortened, that end date moves forward.

Is a claim report in the CIS database a problem?

A claim report only means that a claim was made under a policy; it is not a fraud signal. It can, however, be taken into account for the premium and the terms. If a claim report is presented as though it concerns fraud, that is a point to raise.
