Recovering overpaid rent in the Netherlands: effective dates, calculation and payment

A lower rent does not always entitle you to recover every earlier payment. The legal route establishing the lower amount determines the effective date. Separate that question from the calculation, finality of the decision and recovery from the landlord.

Editorial review: Arslan Advocaten. Updated 24 October 2026.

Initial rent and a later reduction have different effects

A timely initial-rent assessment can set the rent from the agreement’s commencement. A reduction after a later proposal generally applies from its effective date instead. Earlier months do not automatically fall within that later procedure. Reductions for defects and all-in-rent disputes have their own rules and dates.

A high points-based rent discovered years later

Outside an established adjustment route, repayment can be legally uncertain and depends on the contract, period and other circumstances. Do not assume that every historical payment above today’s calculator result lacked a legal basis. Check the actual decision, applicable regime and limitations before sending a demand for the entire tenancy.

Calculate month by month

For each relevant month record rent paid, rent legally due and the difference. Keep service-charge advances separate and account for changes that genuinely affect the calculation. A hypothetical example: if €100 too much was paid for five months covered by the decision, the starting difference is €500. That is an illustration, not a result in a client case.

Check whether the decision is contested

A Huurcommissie decision can lead to an eight-week period for bringing the underlying dispute to court. Verify the sending date and any proceedings before treating the position as settled. The Tribunal does not collect or transfer your refund. Ask for payment in writing with the calculation, account details and a reasonable deadline.

If the landlord does not pay

Have the next collection or court step assessed. Interest, limitation and any set-off need their own legal basis. Withholding future rent without a properly assessed right can create arrears. Keep proof of the demand and response; a general complaint does not necessarily preserve every repayment claim against limitation.

Documents to collect

  • Decision or agreement setting the lower rent
  • Sending date and information on court proceedings
  • Complete monthly rent statement
  • Bank payment records
  • Repayment demands, replies and any set-off notice

Frequently asked questions

Does every reduction run back to my move-in date?

No. The route and effective date determine which months are affected.

Will the Tribunal collect the money?

No. Repayment and enforcement are separate steps.

Can I deduct the refund from next month’s rent?

Set-off requires a specific legal assessment. Do not assume any claimed refund can simply replace rent payment.

Discuss the right next step

Send the complete agreement, relevant correspondence and the next deadline. We first assess the legal question, evidence and appropriate route. The first consultation is free and without obligation. Eligible individuals may qualify for subsidised legal aid; a personal contribution or other costs can remain. Where private fees apply, we agree the scope and expected costs before further work. A contact request does not itself preserve a statutory or court deadline.
