Initial rent assessment in the Netherlands: deadlines, evidence and effect

The initial-rent procedure asks the Huurcommissie whether the rent agreed at the start was reasonable under the applicable rules. A timely assessment can affect rent from commencement. This is different from a later proposal to reduce ongoing rent.

Editorial review: Arslan Advocaten. Updated 24 October 2026.

The deadline depends on the agreement

For an ordinary indefinite tenancy, the initial-rent request generally has to be filed within six months after commencement. A qualifying temporary contract under the older Wet doorstroming huurmarkt can have a deadline up to six months after it ends. Not every temporary or student arrangement falls under that older exception. Have the start date and legal classification checked immediately.

Assess the home at the relevant time

The condition and facilities at the start are central to this procedure. Keep the check-in report, photographs, floor measurements, energy information and advertisement. Later renovations or an altered layout should not simply be substituted for the initial position. Preserve evidence if the home has already been changed.

A high starting rent does not rule out a request

The agreed amount is not the sole test for whether the initial rent can be examined. The applicable points system, contract date and legal regime determine the outcome. Separate independent accommodation from room rental and check any permitted price surcharge. A rough online estimate is a starting point, not the completed file.

What the decision can mean financially

If the initial rent is set lower, the effective date can be the start of the agreement, creating a difference between rent paid and rent due. Calculate each month, including any relevant later adjustments. The Huurcommissie does not itself transfer the overpayment to you. A repayment demand and, if necessary, enforcement are separate steps.

Do not confuse negotiation with filing

A letter asking the landlord for a reduction does not by itself preserve the initial-rent deadline. Check the proper application, required documents and fees. After the decision, distinguish the period for taking the dispute to court from the time needed to calculate a refund. If the initial route is no longer available, a prospective reduction may still require assessment.

Documents to collect

  • Agreement and exact commencement date
  • Evidence of the home’s initial condition
  • Points calculation and underlying measurements
  • Starting rent, increases and payment history
  • Notices concerning any temporary term

Frequently asked questions

Does a letter to the landlord preserve the six-month deadline?

Do not assume so. A timely request through the proper procedure is a separate act.

Does every rent reduction run from the contract’s start?

No. The initial-rent procedure differs from a later reduction following a proposal.

Does the Huurcommissie pay the refund?

No. You must arrange repayment or take further steps if the landlord does not comply.

Discuss the right next step

Send the complete agreement, relevant correspondence and the next deadline. We first assess the legal question, evidence and appropriate route. The first consultation is free and without obligation. Eligible individuals may qualify for subsidised legal aid; a personal contribution or other costs can remain. Where private fees apply, we agree the scope and expected costs before further work. A contact request does not itself preserve a statutory or court deadline.
