Social, middle or free-sector rent: which rules apply to your Dutch home?

The rent sector determines important price controls and procedural options. The amount on the contract is not the whole answer. For an independent home, assess the points, contract history and rules applicable when the tenancy began.

Editorial review: Arslan Advocaten. Updated 24 October 2026.

Know the points bands

Under the newer framework for independent homes, up to 143 points belongs to the social segment, 144–186 points to regulated middle rent and 187 or more can fall into the free sector. Do not apply that shorthand indiscriminately to older contracts, rooms or special accommodation. Transitional provisions can affect an existing tenancy.

An annual money threshold is not every home’s maximum

The monetary boundaries change over time. Within a regulated segment, the actual maximum depends on the property’s own points and the applicable price schedule. A home with fewer points does not automatically receive the maximum for the entire segment. Keep the assessment year and relevant starting date clear.

Older free-sector contracts require special care

The extension of middle-rent regulation from 1 July 2024 does not mean every older liberalised tenancy becomes regulated middle rent. Review the original basic rent, start date, points and transitional position. A later rent increase or replacement document does not by itself answer whether the legal regime has changed.

Surcharges and the WOZ component

Qualifying monuments or new-build middle-rent homes can raise separate permitted-price questions. Such a price addition does not simply convert the underlying points classification into free sector. WOZ-related limits and exceptions also need examination. Ask for the proof behind every claimed exception rather than treating a landlord’s label as conclusive.

Connect classification to the right next step

A correct classification helps identify the applicable increase limit, initial-rent assessment or reduction procedure. It does not decide every service-charge, repair or termination question. Compare basic rent separately from advances, calculate the points with evidence and check deadlines before proposing a different payment.

Documents to collect

  • Original start date and basic starting rent
  • Full contract history
  • Points calculation and facilities
  • Energy label and WOZ information
  • Evidence supporting any surcharge

Frequently asked questions

Can the contract simply call the home free sector?

The label does not replace the legal assessment of the agreement and property.

Do yearly thresholds stay the same?

No. Use the schedule for the relevant date and distinguish a segment boundary from the property’s own maximum.

Does a monument surcharge change the points band automatically?

A permitted price surcharge is not simply a reclassification. Check the specific rules.

Discuss the right next step

Send the complete agreement, relevant correspondence and the next deadline. We first assess the legal question, evidence and appropriate route. The first consultation is free and without obligation. Eligible individuals may qualify for subsidised legal aid; a personal contribution or other costs can remain. Where private fees apply, we agree the scope and expected costs before further work. A contact request does not itself preserve a statutory or court deadline.
