The Affordable Rent Act, Wet betaalbare huur, took effect on 1 July 2024. It extends regulated rent into the middle segment and makes the dwelling’s points and the contract date central. It does not mean that every existing private-sector tenancy immediately receives a lower rent.

Start with the dwelling and the starting date
Establish whether you rent a self-contained dwelling or a room, when the agreement began and the condition at the relevant assessment date. The rules for a room are different. For independent homes under the new system, up to 143 points falls within the social segment, 144–186 within the regulated middle segment and 187 or more can fall outside that points-regulated segment. Contract and transitional rules remain important.
What the points system assesses
The WWS system values aspects such as size, facilities, energy performance and WOZ value. Restrictions and exceptions can affect the result. Obtain the landlord’s calculation and make your own calculation using the appropriate official tool. A high rent stated in the agreement does not itself establish that the dwelling belongs in the free sector.
Older contracts need a transitional assessment
Do not apply the rules for a new middle-rent tenancy indiscriminately to an older liberalised contract. Some low-points dwellings and existing arrangements are affected by transitional rules, while other existing tenancies retain a different regime. Keep the original starting rent and earlier contracts. A new document may be an amendment rather than a genuinely new tenancy.
Lowering the initial rent or the ongoing rent
An initial-rent assessment and a later proposal to reduce rent have different time limits and starting dates. An ordinary indefinite tenancy generally requires an initial-rent request within six months after commencement; a qualifying older temporary tenancy may follow a different deadline. A later reduction is not automatically retroactive to the first day of the contract.
Municipal enforcement is not the whole private claim
A missing points statement or excessive regulated rent may also raise municipal enforcement questions. A report does not itself produce repayment of every amount already paid. Keep the rent dispute, reporting route, service charges and any court deadline distinct. Obtain a written agreement or the appropriate decision before assuming your monthly obligation has changed.

Frequently asked questions
Does the Act reduce every free-sector rent?
No. The contract date, points and transitional rules must be checked.
Does a higher agreed rent make a home free sector?
The amount written in the contract is not the only test. The applicable regime and points need assessment.
Can I simply pay the points-based amount now?
Do not assume that a calculation alone changes the rent. Select the correct agreement or procedural route.
Discuss the right next step
Send the complete agreement, relevant correspondence and the next deadline. We first assess the legal question, evidence and appropriate route. The first consultation is free and without obligation. Eligible individuals may qualify for subsidised legal aid; a personal contribution or other costs can remain. Where private fees apply, we agree the scope and expected costs before further work. A contact request does not itself preserve a statutory or court deadline.
